Towards an EU regulatory framework for AI and Algorithmic Management in the workplace?

This research paper examines the emerging need for a dedicated European Union (EU) regulatory framework on artificial intelligence and algorithmic management in the workplace. It maps recent national legislative and collective bargaining developments across EU Member States. It then assesses the limits of the current EU acquis, particularly the General Data Protection Regulation, the Artificial Intelligence Act and the Platform Work Directive. The analysis argues that horizontal risk-based instruments do not adequately address the specific power asymmetries of employment relations, while the Platform Work Directive offers a more worker-centred model but remains limited in scope. Against the backdrop of EU simplification and competitiveness agendas, the paper argues for a comprehensive EU instrument on AI at work. Such an instrument should combine preventive risk-management tools with enforceable labour rights, extend protections to all workers regardless of status, strengthen collective participation, guarantee transparency and explanation rights and establish accountability for both AI providers and deployers.
